SUING A LOAN MODIFICATION COMPANY 

Research has found ambiguous results of such legislation, including finding that high-cost mortgage applications can possibly rise after adoption of laws against predatory lending.

  1. If you have Spent Money with a loan modification company that you feel is not holding up to their promises and is not doing anything to make your situation better, you may be entitled to AT LEAST 3 times the amount of money you paid that company for your loan modification.  If you are having trouble with your current loan modification company, call us
  2. Just because a company advertises for loan modifications, doesn't mean that they are licensed to conduct that type of business.  If you feel your current loan modification company may not be licensed, call us.
  3. If you are unsure who to trust for a loan modification, call us.
If within the last 3 years you have paid anyone other than a lawyer to:

Stop or postpone a foreclosure sale
Modify or lower your mortgage payments
Receive surplus funds generated from foreclosure of your home
Perform any service related to your mortgage or foreclosure of your home

You may be entitled to:

Compensatory Damages; and/or
Punitive Damages equal to at least what you paid!

For example, if you paid $3,000 to a Loan Modification company to negotiate with a bank on your behalf or prevent a foreclosure, under California law you may be entitled to get up to $9,000 back from that Loan Modification company, as well as additional damages.



Even if the Loan Modification company was partially successful in lowering your monthly mortgage, you may still be entitled to get all of your money back if you were not given proper notice or if the Loan Modification company took money from you before its services were completed.



It does not matter what the Loan Modification company had you sign. You cannot waive or give up these rights. Any attempt by the Loan Modification company to force you to do so is illegal and unenforceable.
